Your access to and continued use of any Services, including this Website, constitutes your acceptance of and compliance with the Terms. Nothing in the Terms gives any user the right or license to use any trademark used in association with the Website or Services without the express permission of the owner.

The contents of the Website or Services along with other informational materials provided by, through, or to the CADA, such as text, publications, newsletters, articles, opinions, views, graphics, images, HTML code, multimedia clips, Java code, e-mail or internet links, and the selection and arrangement of information (the “Content”), are protected by copyright and other intellectual property laws under both Canadian and foreign laws. Unauthorized use of the Content may violate copyright, trademark, patent or other laws. You must retain all copyright, trademark and other proprietary notices contained in the original Content or on any copy you make of the Content.

These links are provided solely as a reference to help you identify and locate other Internet resources that may be of interest to you.  Any Job Boards accessed from this Website are subject to the terms and conditions, including applicable privacy policies, of those Job Boards and you are responsible for determining those terms and conditions and complying with them. The inclusion of any link to a Job Board does not imply endorsement by the CADA. Any mention of a Job Board should not be construed as an endorsement by the CADA of the Job Board.

Changes to the Service or Website & Suspension

We reserve the right to alter, suspend, or discontinue any aspect of the Website or the Services, in whole or in part, at any time and without notice or liability to you, and for any reason or no reason, including by: (a) adding, removing or modifying functionality or features; (b) adding, removing, modifying, correcting or refusing any Content on the Website or through the Services; (c) limiting, suspending or terminating your or any persons access or use of all or parts of the Website and Services; and (d) discontinuing all or any part of the Website and Services. Termination

The CADA may, without prior notice, immediately terminate the Terms or your ability to access the Website or Services or portions thereof, at any time. You acknowledge and agree that all terminations may be made by the CADA in its sole discretion and that the CADA shall not be liable to you or any third-party for any termination of the Terms or your access to this Website or Services or for the removal of any of the Content uploaded by you to the Website or Services (for any reason). Any termination by the CADA shall be in addition to any and all other rights and remedies that the CADA may have. Upon termination for any reason or no reason, you continue to be bound by your obligations and the restrictions and limitations under the Terms and the disclaimers and exclusions and limitations on liability shall continue to apply.

Enforcement of Terms

If any part of the Terms is held to be unlawful, void, or unenforceable, that part shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions. The failure of the CADA to exercise or enforce any right or provision under the Terms shall not constitute a waiver of such right or provision. Any waiver of any right or provision by the CADA must be in writing and shall only apply to the specific instance identified in such writing. No waiver by the CADA of any provision of the Terms shall be deemed to be a further or continuing waiver of such provision or any other provision. To the maximum extent permissible under applicable law, you agree that any cause of action or complaint that you may have arising out of or related to this Website or the Services or your use of this Website or Services must commence within one (1) year after the cause of action or complaint accrues, otherwise such cause of action or complaint shall be permanently barred.

Assignment

The Terms, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by the CADA without restriction.

Conformance with Law

You agree that your use of the Services shall not violate any applicable local, national or international law, including but not limited to any regulations having the force of law. Some jurisdictions may have restrictions on the use of the Internet by their residents.

You agree not to impersonate another person in your use of the Services or the sending of any e-mail to an address provided via the Services, or to use or disclose another individual’s Personal Information without obtaining their express prior consent.

Choice of Law and Dispute Resolution

The laws of the Province of Ontario and the laws of Canada applicable therein shall govern as to the interpretation, validity and effect of this agreement or any dispute between you and the CADA, without regard to principles of conflicts of laws or your domicile, residence or physical location. You hereby irrevocably and unconditionally consent and attorn to the exclusive jurisdiction of the courts of the Province of Ontario in any action or proceeding instituted under or related to the Website, the Services, these Terms, or in relation to any dispute between you and the CADA. You further agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action.
